These Terms govern use of elixirperfume.com and
purchases from By.Eskin LLC, doing business as Elixir
Perfume. By using the store or placing an order, you agree to
these Terms and the Refund & Returns, Shipping, Privacy &
Cookie, and Health, Allergy & Safe-Use policies incorporated by
reference.
Eligibility and acceptable
use
You must be legally able to enter a binding contract. You may not
misuse the site, interfere with security, introduce malicious code,
impersonate another person, submit fraudulent information, scrape
protected content without authorization, or use the store
unlawfully.
Product information
We work to present accurate names, sizes, concentrations, conditions,
images, availability, and prices. Screens and manufacturer batches may
display color, bottle, packaging, ingredients, labeling, or presentation
differently. Tester differences disclosed on the product page are not
defects. Fragrance notes, projection, longevity, and skin performance
are descriptive and subjective, not guarantees.
If a material listing, pricing, or inventory error affects an order,
we may contact the customer, correct or cancel the affected item, and
refund a canceled paid amount.
Authenticity and trademarks
Products are sold as authentic. Brand names and trademarks belong to
their owners and identify genuine goods offered for resale. Unless
expressly stated, Elixir Perfume is an independent retailer and is not
affiliated with, sponsored by, endorsed by, or an authorized dealer of a
manufacturer or trademark owner.
Health and safe use
The separate Health, Allergy & Safe-Use Notice
is incorporated into these Terms. Before purchase and every use, the
customer and intended recipient must review the product page, the
writing and symbols printed on the perfume box, the bottle label,
ingredient information, manufacturer instructions, warnings,
batch-specific notices, and package inserts. The delivered manufacturer
packaging and label control if they differ from a general website
description.
The checkout health acknowledgment records that the customer has read
and understood these disclosures and accepts the ordinary disclosed
risks associated with known allergies, personal sensitivity, misuse,
improper storage, or use contrary to the manufacturer’s instructions, to
the maximum extent permitted by law.
Orders, prices, discounts, and
tax
An order confirmation acknowledges receipt but does not guarantee
acceptance. We may reject, hold, limit, or cancel an order for inventory
or pricing error, fraud review, payment failure, address or shipping
restriction, resale activity, quantity limit, or violation of these
Terms. Paid canceled amounts will be refunded.
Prices are in U.S. dollars. Coupons and promotions may have
exclusions, expiration dates, and usage limits. Free shipping is based
on the merchandise subtotal after coupons and before tax. Applicable tax
is calculated using transaction and delivery information. We do not use
“MSRP” terminology unless a comparison price is authorized and
verifiable.
Payment
Available methods are displayed at checkout and may change. The
customer represents that they are authorized to use the selected payment
method. We may request verification for fraud prevention.
Shipping and returns
The Shipping and Refund & Returns policies control delivery,
claims, return authorization, and return-shipping responsibility. Elixir
Perfume is responsible for outbound merchandise from the store to the
customer as stated in the Shipping Policy. A customer-arranged return,
including its cost and risk of loss or damage, remains the customer’s
responsibility until received and inspected by Elixir Perfume.
Reviews and user content
Submitted content must be truthful, based on the submitter’s
experience, lawful, and non-infringing. We may moderate fraud, abuse,
privacy violations, irrelevance, or unlawful content, but will not
suppress a review merely because it is negative. The submitter grants us
a non-exclusive, worldwide, royalty-free license to host, display,
reproduce, and format voluntarily submitted content for store operation
and promotion, subject to applicable law and the Privacy Policy.
Disclaimer and
limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE
WEBSITE, WEBSITE CONTENT, AND SERVICES ARE PROVIDED “AS IS” AND “AS
AVAILABLE.” EXCEPT FOR AN EXPRESS WRITTEN PROMISE MADE BY ELIXIR
PERFUME, WE DISCLAIM WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED,
INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, DURABILITY, TITLE, AND
NON-INFRINGEMENT.
No website description, fragrance-note summary, review, or
customer-service communication constitutes medical advice or guarantees
subjective scent preference, longevity, projection, or individual skin
compatibility.
Elixir Perfume is not responsible for loss or injury caused by
misuse, ingestion, unsafe application, use near flame or heat, improper
storage, unauthorized alteration, failure to follow package or label
warnings, or continued use after irritation becomes apparent.
To the maximum extent permitted by law, Elixir Perfume and its
owners, employees, affiliates, agents, and providers are not liable for
indirect, incidental, special, exemplary, punitive, or consequential
damages. For claims that may lawfully be limited, aggregate liability
will not exceed the greater of the amount paid for the specific product
giving rise to the claim or US $100.
These limits do not apply where prohibited and do not eliminate
responsibility for fraud, intentional misconduct, gross negligence,
non-limitable personal injury, false or misleading statements, an
incorrect product, unauthorized alteration, failure to communicate a
known material safety warning, or another right or responsibility that
cannot lawfully be waived.
Indemnification
To the extent permitted by law, the customer will indemnify Elixir
Perfume against third-party claims and reasonable losses arising from
the customer’s unlawful conduct, fraud, material breach, unauthorized
resale, product misuse or alteration, or violation of another person’s
rights. This does not cover responsibility caused by Elixir Perfume’s
own conduct where it cannot lawfully be transferred.
Governing law,
severability, and changes
These Terms are governed by Florida law, without regard to
conflict-of-law rules, except where another jurisdiction’s mandatory
consumer law applies. If a provision is unenforceable, the remaining
provisions continue to the extent permitted. Updated Terms apply
prospectively; the version in effect when an order was placed governs
that transaction unless law requires otherwise.
